CANCELLED – ADJOURNED
I was just informed on Monday afternoon, that our scheduled hearing to complete the SLAPP application in our civil case with the City of Kelowna, has been cancelled and will have to be heard at some future unknown dates.
A criminal trial was booked at the same time as our civil hearing, (when this was done, I do not know) and the criminal hearing takes precedence. I am unsure when this will be heard.
The City served me last Tuesday, with a 36 page written argument, into my submissions so far. All my submissions of course, were in my original application to the Court, so the City has had over ½ year of knowledge of my position. I requested them to serve me by the beginning of November, which they agreed to do – and failed to do so.
I was preparing all last week for the Thursday hearing of my application to have the probation order stayed pending the appeal of the conviction against me on the falsified assault charges, and have had virtually no opportunity to study and prepare any response.
